Terms and Conditions
We are Culturepush Pte. Ltd. and we own and operate this website (“Site”) at Cultjobs.com. These terms of use (these “Terms”) govern your access to and use of Cultjobs.com, the website and its subdomains (the “Site”) and all services provided by Cultjobs.com and the subdomain operators in relation to Cultjobs.com (the “Services”).
1. DEFINITIONS
In these Terms, the following terms shall have the meanings set forth below:
“Employer” refers to an employer who lists job opportunities or a company profile on Cultjobs.com or is logged into an Employer account.
“Job Seeker” refers to an individual user who accesses the Site, or is logged into a Job Seeker account.
“Personal Data” refers to personally identifiable information about individuals including their name, phone number, email address, contact details, resume and other personal information incidental to such individual’s interaction with the Services, but excluding any business contact information.
“Services” refers to the services available on or through the Site.
“Users” collectively refer to Employers and Job Seekers, and each are referred to as “User”.
“User Content” refers to information posted by Employers and Job Seekers, or posted by Cultjobs.com on behalf of Employers or Job Seekers, in the form of text, images, photographs, video, audio and graphics that are available on the Site.
“Website Content” refers to all information, text, images, data, links, or other material posted on the sections of the Site: (i) that are publicly available; and (ii) which you have the right to access, whether created by us or provided by a third party for display on the Site.
2. ACCEPTANCE OF TERMS
2.1 Your use of this Site is subject to these Terms of Use. By using the Site, you are deemed to have accepted and agree to be bound by these Terms of Use. We may make changes to these Terms of Use from time to time. We may notify you of such changes by any reasonable means, including by posting the revised version of these Terms of Use on the Site. Your use of the Site following changes to these Terms of Use will constitute your acceptance of those changes.
3. ABILITY TO ACCEPT TERMS OF USE
3.1 You affirm that you are either more than 16 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use.
4. SITE ACCESS
4.1 You are responsible for all access to the Site using your internet connection, even if the access is by another person.
4.2 We will use reasonable efforts to ensure that the Site is available at all times. However, we cannot guarantee that the Site or any individual function or feature of the Site will always be available and/or error free. The Site may be unavailable during periods when we are implementing upgrades or carrying our essential maintenance on the Site.
5. ACCESS TO SITE OUTSIDE OF SINGAPORE
5.1 We make no promise that the materials on the Site are appropriate or available for use in locations outside Singapore. Accessing the Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Site from elsewhere, you do so on your own initiative and are responsible for compliance with local laws.
6. YOUR USE OF THE SITE
6.1 Your permission to use the Site is personal to you and non-transferable, and you may not use the Site for commercial purposes. Your use of the Site is conditional on your compliance with the rules of conduct set forth in these Terms of Use and you agree that you will not:
6.1.1 Use the Site for any fraudulent or unlawful purpose;
6.1.2 Use the Site to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including without limitation others’ privacy rights or rights of publicity;
6.1.3 Impersonate any person or entity, false state or otherwise misrepresent your affiliation with any person or entity in connection with the Site or express or imply that we endorse any statement you make;
6.1.4 Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available or violate any requirements, procedures, policies or regulations of such networks;
6.1.5 Transmit or otherwise make available in connection with the Site any virus, worm or other computer code that is harmful or invasive or may or is intended to damage the operation of, or to monitor the use of, any hardware, software, or equipment;
6.1.6 Reproduce, duplicate, copy, sell, resell or otherwise exploit for any commercial purposes, any portion of, use of, or access to the Site;
6.1.7 Modify, adapt, translate, reverse engineer, decompile or disassemble any portion of the Site. If you wish to reverse engineer any part of the Site to create an interoperable program you must contact us and we may provide interface data subject to verification of your identity and other information;
6.1.8 Remove any copyright, trade mark or other proprietary rights notice from the Site or materials originating from the Site;
6.1.9 Frame or mirror any part of the Site without our express prior written consent;
6.1.10 Create a database by systematically downloading and storing Site content;
6.1.11 Use any manual or automatic device in any way to gather Site content or reproduce or circumvent the navigational structure or presentation of the Site without our express prior written consent. Notwithstanding the foregoing, we grant the operators of public online search engines limited permission to use search retrieval applications to reproduce materials from the Site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of such materials solely in connection with each operator’s public online search service.
6.2 We reserve the right to revoke these exceptions either generally or in specific instances.
ADDITIONAL TERMS FOR JOB SEEKERS
6.3.1 You agree that you shall only use the Site for lawful purposes and seeking employment. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any resume or information uploaded to the Site. You agree that you shall not:
- Post incomplete, false or inaccurate resume information or data on the Site; or
- Respond to any job vacancy advertisement for any reason other than to apply for the job advertised.
6.3.2 You agree and consent that your resume and related information or data may be assessed by Employers who have subscribed to the services of Cultjobs.com for the sole purpose of recruiting and assessing the suitability of potential employees.
6.3.3 Cultjobs.com will not be responsible or held liable in any way if any Employer or person in breach of these Terms, whether in Singapore or elsewhere, uses the Job Seeker’s personal data, information or materials for any purpose other than for recruiting potential employees. You accept that all personal data, information or material given to the Employers or submitted on or through the Site are given entirely at your own risk.
6.3.4 You confirm and acknowledge that you disclose your Personal Data and all other information to the Employers and/or Cultjobs.com of your own volition when you apply for available job vacancies posted on or through the Site, and/or when you use the Site for purposes of submitting, uploading or posting your resume on the Site. By submitting, uploading or posting your resume on the Site, ou authorise Cultjobs.com to store your resume, Personal Data and information related thereto in the database of Cultjobs.com (“Database”), at your own risk unless and until you choose to delete them.
6.3.5 You may send your resume and the related information or data directly to any Employer who advertises on or through the Site. Alternatively, you may send your resume and the related information or data to Cultjobs.com through the Site in reply to any job advertisement.
6.3.6 You acknowledge and agree that your resume and the related information or data may be accessed by the Employers who have subscribed to the services of Cultjobs.com for the sole purpose of recruiting and assessing the suitability of Job Seekers.
6.3.7 Cultjobs.com also reserves the right to reject, disapprove or edit any part of the Job Seeker’s resume and information or data related thereto as it sees appropriate and to erase any personal data which Cultjobs.com reasonably believes that such information or data are inaccurate, false, illegal, unlawful, infringe copyright / trademark / trade name / trade secret or infringe any other intellectual property rights or invade the privacy of the other having regard to the purpose (including any directly related purpose) for which the data are or are to be used.
6.3.8 You acknowledge and agree that Cultjobs.com:
- May charge Employers a fee for access to the Site, the Database and/or Job Seekers’ resumes, details and information or data related thereto for the sole purpose of recruiting and assessing the suitability of Job Seekers and subject to the terms herein. You also recognise that you shall have no claims to any such fee received by Cultjobs.com.
- May determine whether your resume and/or account information or any other individuals’ resume and/or account information match certain job descriptions, company profiles or other Employer data, and provide your resume and information collected pursuant to this Privacy Policy, including Personal Data, to Employers that may be interested in contacting you, without you applying for the job vacancy, for the sole purpose of enabling Employer to recruit and assess the suitability of Job Seekers in relation to any job vacancy.
- May use your personal data (without your name, address and other personal identifiable information) for marketing purposes which may be directed to either potential Employers, their respective agents or anyone under their employment.
6.3.9 Although Cultjobs.com shall use its reasonable endeavours to restrict access to the Database only to the Employers and personnel of Cultjobs.com, it does not guarantee that other parties will not, without Cultjobs.com’s consent, gain access to the Database.
6.3.10 Cultjobs.com will not be responsible or held liable in any way if any Employer or other parties, in breach of the Terms, whether in Singapore or elsewhere, uses the Job Seeker’s personal data, information or materials for any purpose other than for recruiting potential employees. Job Seeker accepts that all personal data, information or materials given to Employer or other users, or submitted on or through the Site, are given entirely at your own risk.
ADDITIONAL TERMS FOR EMPLOYERS
6.4.1 You are solely responsible for the content and material you post on the Site. You agree that you shall only use the Site for lawful purposes and promoting any job-related activities. You agree that you shall not use the Site to:
- Post jobs in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to employment, data privacy and intellectual property
- Sell, promote or advertise products or services;
- Post any franchise, pyramid scheme, distributorship or multi-level marketing opportunity;
- Promote any activity that does not represent bona fide employment;
- Advertise sexual services or seek employees for jobs of a sexual nature
- Respond to, or reach out to, any Job Seeker other than in connection with your job application. Any communications or use of the Site for any purposes other than recruitment purposes, including but not limited to soliciting of donations or business for any reason, are strictly prohibited.
6.4.2 Subject to these Terms and any contract you may have with Cultjobs.com, you are entitled to access Job Seekers’ resume and any other account information provided to you by Cultjobs.com for the purpose of recruiting and assessing the suitability of Job Seekers. You agree that all information or data obtained as a result of such access shall only be used for the sole purpose of recruiting and assessing the suitability of Job Seekers and that such information or data shall not be disclosed to any other parties without the express consent of the Job Seeker concerned. Employer acknowledges and agrees that it shall disregard any information or data received from Job Seeker which is irrelevant to recruiting and assessing the suitability of Job Seekers.
6.4.3 Employer shall be solely responsible for the contents of and materials contained in its job and/or company listing posted on the Site. Cultjobs.com reserves the right to remove or edit, or require the removal or amendment of, any content or material uploaded by the Employer as it sees appropriate, or to terminate or suspend the Employer’s access and use of the Site and/or services offered on or through the Site, in accordance with the agreement for such services between Employer and Cultjobs.com.
6.4.4 Cultjobs.com shall have the right to terminate any services offered to any Employer and to remove any job and/or company listing posted on the Site at Cultjobs.com’s sole discretion, at any time for any reason, without any compensation or recourse to Employer in the event that the relevant Employer or the contents of the relevant advertisement and/or web page is or are in breach of any of the provisions herein; whereas, in the event that Cultjobs.com decides to remove a job and/or company listing for any reasons not relating to any breach of the provisions herein, Cultjobs.com may after deducting any fees charged for the period that the job and/or company listing has been posted on the Site, refund the remaining fees (if any) to the relevant Employer.
6.4.5 From time-to-time Cultjobs.com may invest in marketing campaigns to promote your employer brand (including but not limited to Google ads, Yahoo – Bing ads, Baidu ads, Facebook ads, Twitter ads, ad networks, Demand Side Platforms, Real Time Bidding, retargeting and other programmatic buying strategies) and acknowledge that such promotion may be outside the domain of Cultjobs.com, our subsidiaries or affiliates.
6.4.6 Cultjobs.com also reserves the right to change the service fee or institute new charges or fees, from time to time, as it deems appropriate. In the event that any Employer fails to pay the service fee or any other fees or charges due to Cultjobs.com, Cultjobs.com reserves the right to suspend or terminate the Employer’s access to Cultjobs.com’s Services without prejudice to all other rights and remedies available to Cultjobs.com.
7. THIRD PARTY WEBSITES
7.1 The Site may provide links to other websites and online resources. We are not responsible for and do not endorse such external sites or resources. Your use of third party websites and resources is at your own risk.
7.2 You may create a link to this Site, provided that:
7.2.1 The link is fair and legal and is not presented in a way that is:
- Misleading or could suggest any type of association, approval or endorsement by us that does not exist, or
- Harmful to our reputation or the reputation of any of our affiliates;
7.2.2 You retain the legal right and technical ability to immediately remove the link at any time, following a request by us to do so.
7.3 We reserve the right to require you to immediately remove any link to the Site at any time and you shall immediately comply with any request by us to remove any such link.
8. INTELLECTUAL PROPERTY
8.1 The intellectual property rights in the Site and all of the text, pictures, videos, graphics, user interfaces, visual interfaces, trademarks, logos, applications, programs, computer code and other content made available on it are owned by us and our licensors. You may not print or otherwise make copies of any such content without our express prior permission
9. LIMITATION OF LIABILITY
9.1 We provide the Site on an “as is” basis and make no representations as to the quality, completeness or accuracy of any content made available on the Site. To the maximum extent permitted by law, we expressly exclude:
9.1.1 All conditions, warranties and other terms that might otherwise by implied by law into these Terms of Use; and
9.1.2 Any and all liability to you, whether arising under these Terms of Use or otherwise in connection with your use of the Site.
9.2 The foregoing is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. Notwithstanding the foregoing, nothing in these Terms of Use is intended to exclude or limit any liability that may not by law be excluded or limited, and in particular none of the exclusions and limitations in this clause are intended to limit any rights you may have as a consumer under Singapore law or statutory rights which may not be excluded, nor in any way to exclude or limit (site owner) liability to you for death or personal injury resulting from our negligence or that of our employees or agents.
10. COLLECTION OF PERSONAL INFORMATION

11. DURATION OF TERMS
11.1 These Terms of Use are effective until terminated. We may, at any time and for any reason, terminate your access to or use of the Site. If we terminate your access to the Site you will not have the right to bring claims against us or our affiliates with respect to such termination. We and our affiliates shall not be liable for any termination of your access to the Site.
12. GOVERNING LAW
12.1 These Terms of Use will be governed by and construed in accordance with the laws of Singapore, and the courts of Singapore will have non-exclusive jurisdiction over any claim or dispute arising under or in connection with these Terms of Use.
